Terms of Service

These terms cover your use of uxearchAI. They apply to researchers — the people and product teams running user research studies — and to testers who take part in those studies. By creating an account you agree to them.

uxearchAI is in early access and is offered as-is while we build it. Features may change or break, and we may contact you for feedback.

Accounts

You must be 18 or older to use uxearchAI. During early access, taking part in studies as a tester is open to residents of the Philippines. Give accurate information when you sign up, keep your password to yourself, and tell us if you think someone else has got into your account.

Who the account holder is. Every account belongs to one named individual, who signs in to it and is responsible for what happens on it. Accounts are personal: do not share your login or let anyone else use it. One account may hold both the researcher and the tester role.

Researchers acting for an organisation. If you create studies for a company, agency or other organisation, you accept these terms both for yourself and on that organisation's behalf, and you confirm you are authorised to bind it. “Your organisation” means that entity; where these terms let you share something inside your organisation, that means its employees and contractors working on the research, and nobody else. Each person from your organisation who uses uxearchAI needs their own account.

For testers

We do not record your screen. uxearchAI does not capture your screen, any window you have open, or still images of either.

Some studies record your microphone, so the researcher can hear you think aloud as you work; that is off by default and switched on per study. The session tells you which kind you are in before you begin, and where a study records anything we ask for your explicit consent first. Either way you must confirm you are 18 or older.

What the researcher sees. The researcher whose study it is sees your task answers, your ratings and your written notes — and, on a study that records audio, the recording and its transcript. They do not see your name, contact number, payment details or exact location. If a study does record your microphone, treat what you say aloud the way you would treat anything else you are sending them.

You can stop at any time. You can end a session, withdraw from a study, or ask us to delete a recording you have already made — email uxearchai@gmail.com. Our Privacy Policy says how quickly we act on that.

Incentives. Some studies offer an incentive for completing a session. During early access, the incentive for a study — whether there is one, how much, when it is paid, and how we send it — is agreed with you directly before you start. We ask for payment details then rather than holding them on your profile. Nothing on this site is a promise of payment on its own.

We may withhold an incentive for a session that was not genuinely completed. That means a session with no real attempt at the tasks, answers that are clearly not about the product being tested, answers that are duplicated or automated, or a session completed by someone other than the tester it was assigned to. On a study that records audio, a recording in which you did not speak counts too, because thinking aloud is the task. We judge this on what the session shows, never on whether a recording exists — a study that records nothing is judged on its task answers alone. If we withhold an incentive we will tell you why, and you can ask us to look again.

Take part in good faith. Give honest reactions, think aloud as you work, and do not use someone else's identity or a false profile to get matched to studies.

For researchers

Only submit products you are entitled to have tested. By creating a study you confirm you have the right to have the submitted site or product tested, and that doing so breaks no agreement you are under. Submit only pages that are safe to share: no page requiring credentials you cannot share, and nothing containing other people's personal data.

Session data is for your research only. You may use recordings, transcripts and answers internally to understand and improve what you are building. You may not publish or share them outside your organisation, use them to train machine-learning models, attempt to identify or contact a tester outside uxearchAI, or use them for any purpose other than the research the tester consented to.

Researcher data protection obligations

When we give you a transcript, recording or set of task answers, you receive personal data about a real person and you become responsible for it in your own right. These obligations are binding, not advisory, and they survive the closing of your account.

• Purpose limitation. Use session data only for the research purpose stated in the study the tester consented to. Any other use — marketing, recruitment, training data, sale, or a different product — is prohibited.
• Security. Keep session data at least as secure as your own confidential business information, with access limited to the people who need it, and stored on systems under your organisation's control. Do not upload it to third-party tools that would acquire rights over it.
• Flow-down. Anyone you share session data with inside your organisation is bound by these same obligations, and you remain responsible for their compliance.
• Deletion on request. If we tell you a tester has asked for their data to be erased, delete every copy you hold — including copies in notes, exports, decks and backups you control — within 10 working days, and confirm to us in writing when it is done.
• Retention ceiling. Delete session data when it has served the research purpose, and in any case within 12 months of receiving it. Findings and conclusions written in your own words are yours to keep; the underlying recordings, transcripts and identifiable answers are not.
• Breach notification. If session data you hold is lost, exposed or accessed without authorisation, tell us at uxearchai@gmail.com within 24 hours of becoming aware, with what you know at that point. We have 72 hours to notify the National Privacy Commission and the people affected, and we cannot meet that deadline if you sit on it.
• No re-identification. Do not attempt to determine a tester's identity, combine session data with other sources to identify them, or contact them outside uxearchAI.
• Cooperation. Help us respond to a tester's access, correction or erasure request, and to any enquiry from the National Privacy Commission, within the time we ask.

Recordings are deleted on schedule. Where a session produced a recording, we delete it 90 days after the session. Transcripts and reports follow the schedule in our Privacy Policy. If you need something beyond that window, take your own notes from the report.

Reports are AI-generated. Findings, severity ratings and summaries are produced by automated analysis of what a session captured — the tester's answers, ratings and notes, and the transcript where the study recorded audio. They can be wrong, incomplete, or misleading. Check them against the underlying session before acting on them. They are not professional advice.

Pricing. uxearchAI is free during early access. We will give notice before introducing charges, and you will never be charged without agreeing first.

Acceptable use

Whichever kind of account you hold, do not:

• Break the law, or use uxearchAI to harass or harm anyone.
• Try to access accounts, data or systems that are not yours.
• Probe, scrape, overload or reverse-engineer the service.
• Upload malware, or submit a page designed to attack whoever visits it.
• Create accounts in bulk, or misrepresent who you are.

Your content

You keep ownership of what you provide — a researcher's study details, a tester's recording and answers. You grant us the licence we need to host, process and transmit it in order to run the service, including transcribing and analysing recordings as described in our Privacy Policy. That licence ends when the content is deleted.

Suspension and ending your account

You can stop using uxearchAI and ask us to close your account at any time. We may suspend or close an account that breaks these terms, or that puts testers or researchers at risk. The researcher data protection obligations above, and any liability already incurred, survive the end of your account.

Disclaimers and liability

uxearchAI is provided as-is and as-available, without warranties of any kind. We do not guarantee that the service will be uninterrupted, that matching will find suitable testers, or that reports will be accurate.

To the fullest extent the law allows, we are not liable for indirect, incidental or consequential loss, or for lost profits, revenue or data.

Our total liability to you for all claims arising out of or relating to these terms or the service is limited, in aggregate, to the greater of PHP 25,000 or the total amount you paid us in the twelve months before the event giving rise to the claim. Because uxearchAI is free during early access, that will usually be PHP 25,000.

Nothing in these terms limits liability that cannot legally be limited — including for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability under the Data Privacy Act that may not be excluded.

General

Entire agreement. These terms and our Privacy Policy are the whole agreement between us about uxearchAI, and replace anything said or written beforehand. Nothing here excludes liability for fraudulent statements.

Severability. If a court finds any part of these terms unenforceable, that part is treated as narrowed to the extent needed to make it enforceable, or removed if it cannot be, and the rest stays in force.

No waiver. If we do not enforce something straight away, we have not given up the right to enforce it later.

Assignment. You may not transfer your account or your rights under these terms without our written consent. We may transfer ours to a successor in connection with a merger, acquisition or sale of the business, provided the successor is bound by these terms and by our Privacy Policy; we will tell account holders by email before that takes effect.

Force majeure. Neither of us is liable for a failure to perform caused by something outside our reasonable control — including natural disaster, epidemic, war, civil unrest, government action, industrial dispute, or the failure of a power grid, telecommunications network or third-party provider. This does not excuse payment obligations already due, and it does not excuse a breach of the data protection obligations above.

Independent parties. Nothing in these terms creates an employment relationship, partnership, joint venture or agency between us. Testers take part as independent individuals and are responsible for their own taxes on any incentive received.

Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws rules. If we cannot resolve a dispute between us informally, it will be brought exclusively in the courts of San Juan City, Metro Manila, Philippines, and we each consent to those courts' jurisdiction. Before filing, please email uxearchai@gmail.com and give us 30 days to put it right — most things are faster to fix than to argue about.

Nothing here stops you complaining to the National Privacy Commission about how we handle your personal data, or affects any right you have under Philippine consumer protection law.

Changes to these terms

We may update these terms; if a change is material we will tell account holders by email, and for testers the consent step records which version you agreed to. Every version carries a version label and an effective date, so a consent record always resolves to a specific document.
